Terms of Use and Sale — bail.immo
Effective date: 11 May 2026
These Terms of Use and Sale (the "Terms") govern access to and use of the bail.immo website, its lease analysis tools, document generation tools, landlord workspace, and free and paid services.
By checking the acceptance box, uploading a document, creating an account, launching an analysis, generating a document, subscribing to a plan, or using the site, you accept these Terms without reservation.
1) Definitions
In these Terms:
- "Service" means the bail.immo website, its interfaces, APIs, forms, automated analyses, exports, generated documents, dashboards, and related features.
- "User" means any person who consults or uses the Service.
- "Account" means a User's personal workspace.
- "Document" means any lease, contract, appendix, supporting document, image, PDF, Word file, text, or data submitted to the Service.
- "Analysis" means any result, summary, qualification, alert, recommendation, explanation, score, legal reference, or output automatically produced by the Service.
- "Third-Party Provider" means, among others, hosting, payment, email delivery, usage analytics, security, artificial intelligence, OCR, geocoding, mapping, or any other provider necessary for the Service to operate.
2) Purpose of the Service
bail.immo provides digital tools designed to facilitate rental management and the understanding of real-estate documents, notably:
- partial or full automated analysis of leases and rental documents;
- plain-language explanations of certain clauses;
- generation of rental documents;
- a landlord workspace to track properties, tenancies, rents, expenses, documents, and simulations;
- exports, history, dashboards, and related features;
- free services and paid services, sold individually or by subscription.
The Service is a technical assistance, information, and productivity tool. It does not constitute a law firm, legal consultation, notarial office, real estate agency, regulated rental management service, or compliance insurance.
3) Acceptance before analyzing a document
Before launching an analysis of a lease or any other document, the User must accept these Terms.
By launching an analysis, the User expressly acknowledges that:
- the Document will be transmitted, stored, extracted, split, analyzed, and transformed by automated systems;
- the Analysis may be partial, approximate, erroneous, incomplete, outdated, or unsuited to the User's particular case;
- certain clauses, pages, appendices, handwritten notes, tables, images, or contextual conditions may not be detected;
- legal references, qualifications, and recommendations may be false, imprecise, missing, or fail to reflect the most recent developments in the law;
- no legal, financial, contractual, or procedural decision should be made on the sole basis of the Service.
4) No legal advice and obligation to obtain professional review
The Service does not provide personalized legal advice.
The Analyses, generated documents, alerts, legal references, recommendations, templates, letters, tax simulations, expense simulations, summaries, and exports are provided for informational purposes only.
The User must always have any lease, contract, generated document, Analysis, conclusion, or recommendation reviewed by a lawyer, a notary, a qualified legal professional, a competent association, a property manager, or any other authorized professional before:
- signing a contract;
- sending a legal letter;
- disputing a clause;
- withholding, paying, invoicing, or settling amounts;
- contentious or pre-contentious proceedings;
- a tax, estate, rental, or financial decision;
- any action likely to have legal consequences.
The User remains solely responsible for their decisions, their verifications, the accuracy of the information provided, and the use of the results.
5) Specific limitations of artificial intelligence
The Service may use artificial intelligence technologies, optical character recognition, text extraction, clause segmentation, classification, and language generation.
These technologies may produce hallucinations, omissions, reasoning errors, reading errors, legal errors, calculation errors, confusion between legal regimes, inaccurate citations, invented references, excessive interpretations, or unsuitable recommendations.
The Service does not guarantee:
- the detection of every illegal, unfair, ambiguous, or unfavorable clause;
- the compliance of a lease or document;
- the accuracy of amounts, dates, areas, addresses, identities, or cadastral references;
- the completeness of applicable texts;
- adaptation to a local, contractual, tax, or personal situation;
- that all case law, administrative practices, legislative updates, or particular circumstances have been taken into account.
Any result should be treated as a lead to verify, never as a definitive legal truth.
6) Account, access, and security
Some features are accessible without an account. Others require creating an Account, authentication, payment, or an active subscription.
The User agrees to provide accurate information, to keep their credentials confidential, and to promptly report any unauthorized access.
The User is responsible for actions taken from their Account, except where a breach is proven to be attributable solely to the Service.
bail.immo may refuse, suspend, or delete access in the event of non-compliance with these Terms, abuse, security risk, fraud, legal request, payment dispute, or behavior harmful to the Service or to third parties.
7) Authorized use
The User may use the Service for their personal needs, internal professional needs, or legitimate rental management purposes, in compliance with the law, the rights of third parties, and these Terms.
The User warrants that they hold the rights, authorizations, or legal bases necessary to transmit Documents and data to the Service, in particular where the Documents contain personal data of tenants, co-tenants, guarantors, owners, agents, or other third parties.
8) Prohibited uses
It is prohibited to:
- transmit Documents obtained unlawfully or without right;
- use the Service to defraud, harass, discriminate against, defame, threaten, or circumvent the law;
- attempt to use an automated legal opinion as a substitute for a legal professional;
- resell, copy, scrape, mass-reproduce, or commercially exploit the Service without written authorization;
- circumvent access, payment, subscription, or security limitations;
- send viruses, malicious scripts, unlawful content, or excessive data;
- harm the integrity, availability, reputation, or security of the Service;
- use the Service to make automated decisions producing legal effects on third parties without qualified human intervention.
9) Documents, data, anonymization, and retention
The User understands and accepts that Documents, extracted text, metadata, Analysis results, history, account data, payment data, usage data, technical logs, and support data may be retained for the periods necessary for the Service to operate, for evidentiary purposes, security, improvement, legal obligations, and management of the user relationship.
Detailed retention periods and terms are set out in the Privacy Policy available at /privacy. In the event of inconsistency, the Privacy Policy governs the operational terms of personal data processing.
Some data may be retained longer where necessary to:
- comply with a legal, accounting, tax, or regulatory obligation;
- prevent fraud, secure the Service, or investigate an incident;
- manage a dispute, a claim, an unpaid amount, or a request from an authority;
- maintain a history accessible from the Account, notably for landlord features;
- improve the quality, reliability, security, and performance of the Service, to the extent permitted by law.
Data may also be aggregated, pseudonymized, or anonymized to produce statistics, market indicators, quality measurements, evaluation datasets, sector analyses, or Service improvements. Where anonymization is effective and irreversible, the data no longer allows a User or a person mentioned in a Document to be identified, directly or indirectly, and may be retained without time limit.
Long-term or indefinite retention of identifying Documents, identifying extracted text, or identifying personal data is not applied as a general rule. It may only occur where a defined purpose, a legal obligation, a documented legitimate interest, a history requested by the User, or a specific agreement justifies it, subject to applicable rights.
10) Use of third parties and data transfers
To operate, the Service may transmit or make certain data accessible to Third-Party Providers, notably for:
- hosting, database, storage, backup, and security;
- text extraction, OCR, document analysis, and artificial intelligence;
- payment, invoicing, taxes, fraud prevention, and the customer portal;
- sending transactional emails;
- audience measurement, observability, logging, support, and diagnostics;
- geocoding, addresses, land parcels, cadastre, or mapping services;
- internal tools necessary to operate and improve the Service.
These Third-Party Providers may process data outside France or outside the European Union according to their own infrastructure. Where applicable law requires it, bail.immo endeavors to put in place appropriate safeguards, such as standard contractual clauses, data processing agreements, security measures, or the selection of providers offering reasonable guarantees.
The User acknowledges that using the Service technically involves the use of these third parties.
Where the User gives separate consent, bail.immo may transmit to commercial partners listed at /partners certain personal data useful for prospecting or proposing services related to the User's real-estate project. This data may include, depending on context, contact details, profile type, the general location of the project, the type of real-estate need, properties entered, expressed preferences, payment or subscription status, actions taken within the Service, and information inferred from forms, documents, or analyses. Full Documents and identifying full texts are not transmitted to commercial partners for prospecting purposes, except upon the User's explicit request or additional specific consent.
Transmission of identifying personal data to independent commercial partners for prospecting, partner offers, brokerage, resale of files, or commercial exploitation distinct from the Service will only take place if the User has been specifically informed and where the applicable legal basis permits it, in particular through separate consent where required. The User may withdraw this consent at any time by writing to privacy@bail.immo.
11) Confidentiality and security
bail.immo implements reasonable technical and organizational security measures to protect the data processed.
However, no computer system is completely secure. bail.immo does not guarantee absolute security, a total absence of breaches, a total absence of data loss, or permanent availability.
The User should avoid transmitting data that is unnecessary, excessively sensitive, or unrelated to the purpose of the Service.
12) Free services, partial analyses, and free features
The Service may offer free features, notably a partial lease analysis, a free account, or certain basic landlord tools.
These features may be limited in volume, duration, depth of analysis, access, export, history, or availability. bail.immo may modify, suspend, or withdraw a free feature, subject to applicable law.
A free or partial analysis should not be interpreted as validation of the complete document.
13) Paid services, subscriptions, and payment
Some services are paid, notably full analyses, exports, landlord subscriptions, advanced features, or future options.
Prices shown at the time of order apply. Payments are processed by a third-party payment provider. bail.immo does not store full credit card data.
Subscriptions are billed according to the chosen frequency, unless cancelled under the terms indicated in the interface or the payment portal. Access to paid features may depend on effective payment confirmation.
In the event of payment failure, dispute, refund, suspected fraud, or subscription expiry, bail.immo may limit, suspend, or convert access to read-only.
Except where mandatory legal provisions or express information provided at the time of purchase state otherwise, digital content and fully performed services may not give rise to a refund once performance has begun with the User's agreement.
14) Availability, maintenance, and evolution
bail.immo endeavors to keep the Service available but does not guarantee continuous, uninterrupted, error-free, or loss-free availability.
The Service may be interrupted, limited, or modified for maintenance, updates, incidents, overload, a Third-Party Provider's decision, legal developments, security, or business reasons.
Features, templates, prices, limitations, workflows, providers, and results may evolve.
15) Intellectual property
The Service, the bail.immo brand, interfaces, texts, structures, templates, databases, graphic elements, code, editorial content, and technical elements are protected by intellectual property rights.
No ownership right is transferred to the User. The User benefits only from a personal, non-exclusive, non-transferable, and revocable right to use the Service in accordance with these Terms.
Documents submitted by the User remain, as the case may be, the property of the User or their rightful owners. The User grants bail.immo the rights necessary to host, copy, process, extract, analyze, transform, display, export, secure, and retain these Documents in order to provide the Service.
16) User's responsibility
The User is responsible for:
- the Documents and data transmitted;
- the accuracy of the information entered;
- the rights they hold over the Documents;
- their decisions and actions taken based on the Service;
- having the results verified by a qualified professional;
- using the Service in compliance with applicable law, notably real estate law, personal data law, consumer law, tax law, and civil law.
The User indemnifies bail.immo against any claim, damage, penalty, cost, or demand resulting from unlawful use, data transmitted without right, or a breach of these Terms.
17) Limitation of bail.immo's liability
To the extent permitted by law, bail.immo may not be held liable for:
- errors, omissions, approximations, hallucinations, or lack of completeness in an Analysis;
- failure to detect an illegal, unfair, unfavorable, or risky clause;
- misinterpretation by the User;
- a decision made without consulting a qualified professional;
- indirect damage, loss of opportunity, loss of income, loss of rent, data loss, business harm, indirect non-material harm, or consequences of a rental dispute;
- an incident attributable to a Third-Party Provider, the Internet, hosting, payment, artificial intelligence, an email service, or a geocoding service;
- inaccurate information provided by the User or present in a Document;
- a subsequent or not-yet-integrated legal, regulatory, or case-law development.
Where bail.immo's liability may legally be engaged, it is limited, to the extent permitted by law, to the amount actually paid by the User to bail.immo during the twelve months preceding the event giving rise to liability.
Nothing in these Terms excludes or limits a liability that cannot be excluded or limited under applicable law.
18) Personal data and GDPR
The processing of personal data is detailed in the Privacy Policy available at /privacy.
The User acknowledges that transmitted Documents may contain personal data of third parties. It is the User's responsibility to inform the persons concerned where required, to hold an appropriate legal basis, and to transmit only the data necessary.
Statistical processing, product improvement, quality measurement, or market analysis may relate to aggregated, pseudonymized, or anonymized data. Anonymized data is not used to re-identify the persons concerned.

19) Termination, deletion, and read-only
The User may stop using the Service at any time.
Deletion of an Account may be requested under the terms of the Privacy Policy. Some data may be retained despite deletion where the law requires it or where a legitimate interest justifies it, notably evidence, security, invoicing, litigation, or fraud prevention.
Upon expiry or termination of a subscription, bail.immo may keep certain history in read-only mode and block the creation of new analyses, exports, or actions reserved for subscribers.
20) Evidence, logs, and communications
Technical logs, timestamps, usage events, payment confirmations, acceptance of terms, transactional emails, and security traces may be used as evidence, subject to applicable law.
Important communications may be sent by email, displayed within the Service, or published on the site.
21) Modification of the Terms
bail.immo may modify these Terms to reflect legal, technical, commercial, pricing, functional, or security developments.
The applicable version is the one published at /terms on the date the Service is used, unless a legal provision or specific notice states otherwise.
In the event of a substantial change, bail.immo may request renewed acceptance.
22) Partial invalidity
If a clause of these Terms is held to be void, invalid, or unenforceable, the other clauses remain applicable. The clause concerned will be interpreted or replaced, to the extent possible, by a valid clause pursuing a similar economic and legal effect.
23) Governing law and dispute resolution
These Terms are governed by French law.
In the event of difficulty, the User is invited to contact bail.immo to seek an amicable solution.
Failing an amicable resolution, the dispute falls within the jurisdiction of the competent French courts, subject to mandatory rules applicable to consumers.
